When you purchase items on our website, send questions or call our operators, or use our Website, we collect and process personal data about you. This document helps you to understand what personal information we collect about you, how we collect it, for what purposes we use it and what your rights to personal data are.
LightWave by Giombattista Migliore is the entity responsible for processing your personal data.
1 Personal data: which we collect and the purposes for which we use them
1.1 Personal data
When you place an order, we will automatically create a card with your data useful for the purpose of shipping and collect the following personal data about you (the "Personal Data"):
- Your name, surname, company name (optional), address, house number, city, zip code, country;
- Your telephone number (optional);
- the VAT number of your company (optional);
- Your email address.
- These data are mandatory for the correct order fulfillment.
In case of simple contact for information request, such as e-mail address and telephone number (by call or whatsApp contact) will not be stored if not associated with an order.
1.2 Information from other services, including social networks like Facebook, Twitter, Google+
You can link your ATB Parts profile to your social network profile, e.g. Facebook and Google+ ("Social Network"). When you use this option we automatically collect selected information about you from Social Networks. The information we collect depends on the information you have made available on Social Networks and on your privacy settings for sharing such information on Social Networks. Depending on your settings and selection, we will collect the following information:
- Name and surname
- Email address
- Address of residence
- Your contacts in social networks
- When you make a request to link your ATB Parts profile with the profile of a social network, we will inform you about what information we will collect from the social network in question. You will receive this information before your request is executed.
You can choose to disconnect your Social Network profile from your Trustpilot profile through your Account. At this point, Trustpilot will remove the unique ID of your social network and will disconnect / revoke Trustpilot from your Social Network. Your profile picture from your Social Network profile will remain on your Trustpilot profile.

1.4 Your IP address, your browser settings and your location
When you visit the Website, we do not register the IP address and browser settings of your computer. The IP address is the numerical address of the computer used to visit the Website. Your browser settings may include the type of browser you use, the browser language and the time zone.
1.5 Summary newsletters and emails
We collect the information you provide when you sign up to receive our newsletters, summarized emails or similar (we collect your name, your email address and newsletter preferences). If you no longer wish to receive our newsletters, summarized e-mails or similar, you can cancel your registration by accessing your Account and changing the settings.
1.6 For what purposes do we use your personal information?
We will use the information provided to us for:
- Offer our services (consultancy for the purchase of spare parts, after-sales after completing an order, promotional offers for the purchase of spare parts)
- Identify yourself as a registered user when you log in to the Website and visit it again
- Check the legitimacy of your data

- Invite you to write reviews on the products marketed
- Answer your questions and provide related customer support
- Contact you if your documentation is not sufficient for the correct fulfillment of an order, or if you do not convince us for the correct identification of the spare parts purchased or for which you request information

1.7 On what legal bases do we process your personal data?
We must process your personal information in order to:
- Perform our contract with you (see Article 6.1.b of the GDPR)
- Respect our legal obligations (see Article 6.1.c of the GDPR) and manage an online sales platform in accordance, for example, with the Unfair Commercial Practices Directive, the ICPEN guidelines on reviews and online approvals, the consumer protection from the unfair commercial practices of 2008, the guidelines of the Antitrust Authority for the online sale, etc.
- Pursuing our legitimate business interests in relation to the management of the Website and the provision of our services to you, or pursuing the legitimate interests of third parties provided that your fundamental interests and rights do not prevail over such interests (see Article 6.1.f of the GDPR ).
- To claim, exercise or defend a legal action, if necessary (see Article 9.2.f of the GDPR)
- Some of these reasons for the processing of your personal data overlap, so there may be several reasons that justify our processing of your personal information.
In the limited circumstances in which you have expressly consented to process your personal data (see Article 6.1.a of the GDPR), for example when you sign up for our newsletters, you are free to withdraw your consent at any time. However, you must be aware that we may have the right to continue processing your information if justified by one of the other legal bases mentioned above.
You have the right to object to the way we treat your personal information, or to ask us to limit its processing. See below, section 13, for more details.

2 Disclosure of personal information
2.1 Disclosure of personal information on the Website
If you make purchases through our company profiles in e-commerce platforms such as ebay or Amazon, these are responsible for the processing of personal data as we do, but only as regards the data accessible to us such as ebay user registry, product purchased , e-mail address, payment method used.
It is advisable to pay attention when deciding what information to make available for disclosure on the Website and to be aware of the fact that, depending on the level of information provided; we recommend that you provide us with the data strictly necessary (and required as mandatory) to enable us to carry out normal work activities in compliance with current legislation.
When you contact us through our chat (provided by Zendesk platform), we use the IP address of your computer to roughly identify your location with respect to the nearest city, this, to allow us to respond to you in your language. We will not use or retain this information except for the sole purpose of answering you to the chat to provide the best customer support. This information is not made available to other users of the Website, nor to third parties, nor to anyone outside of LightWave in general
If you connect to our Social Network profiles, you can ask us for the same services that we would offer in chat or by email or over the phone. The processing of personal data in this case is always the responsibility of the social platforms in which the exchange of information takes place (to which we refer for the verification of the privacy statement). This information is used in exactly the same way as described above, therefore, for the sole purpose of offering our support services, and such data will neither be forwarded nor made available to third parties.
We will never take data such as profile or other photos that are not useful for the purpose of identifying a spare part, an estimate for shipping cost or other. The only images that we will take, for the sole purpose of consultation, will be those of images of the cars, of the spare parts, of any material useful for the purpose of our job offer, of the users who contact us. And they will never be archived, except for the time needed to make a quote or conclude an order by the customer.
2.2 Disclosure to other services, websites and companies
We do not disclose your data to third-party services such as search engines (Google, BIng), social networks, or other sites or applications in general.
2.3 Other disclosures
In addition to the foregoing, we disclose your personal information to the following individuals and in the following circumstances:
- To allow suppliers, consultants and other third-party service providers to perform services on our behalf (such as verification of a chassis number for the purpose of identifying the correct part)
3 Holder of data processing
3.1 Information for which we are the data controller
We are the holder of the processing of personal data provided by you to create and maintain your customer profile, which includes, but is not limited to, your personal data, company name, shipping address, e-mail address, telephone number, number of VAT number.
We are also the data controller of information that is disclosed to other services (see 2.3). The data protection laws of Italy regulate our data collection.
3.2 Information for which you are the data controller
You are the data controller for the content you choose to disclose on the Website, by email, telephone, whatsapp or other contact apps, for social networks and for personal data disclosed when you link your Social profile Network with your profile on the Website.
4 Links to websites
Our Website contains links to other websites. The inclusion of such links on our part does not imply our approval of such websites. We do not control the content of such third-party websites and assume no responsibility for third parties or their policies or practices.
We invite you to read carefully the privacy policies of these third-party websites as their procedures for collecting, managing and processing personal data will differ from ours.
5 Responsible for data processing and transfer of personal information outside the EU
We use external companies to maintain the technical functioning of the Website and our services. These companies are responsible for the processing of personal data for which we are the data controller. By accepting this Statement, you agree that we may also allow the processing of data for which you are the data controller of these data controllers.
We have agreements on the processing of data with data controllers and on the basis of these agreements they must act exclusively in accordance with our instructions. By accepting this Statement, you authorize us to provide instructions to data controllers for the processing of data in accordance with the Notice and for the purpose of using the Website.
Data controllers have taken reasonable technical and organizational measures to protect information against accidental or unlawful destruction, loss or deterioration and to protect information against disclosure to unauthorized persons, misuse or otherwise processing in violation of data protection laws.
At your request, and upon payment of a fee based on the applicable hourly rates of data controllers at any time for such work, data controllers shall provide you with sufficient information to demonstrate that the above mentioned technical and organizational security measures have been adopted.
Some of the aforementioned data processors and third-party services are located outside the European Union, for example in the United States. You consent to our use of data controllers in unsafe third countries as long as there is a regulatory framework governing the transfer of your personal data and ensuring adequate protection, for example, if the data controller is part of the framework agreement called "EU-US Privacy Shield" ("EU-US Privacy Shield").
6 Data storage
We keep the Personal Data and other personal data you provide us for as long as you have an Account or for what is necessary to provide our services. If you choose to delete your account, keep in mind that all your data connected to it will also be deleted. We will delete this information on your request and we will only save a record with the following information: your name, email address and the date of deletion of your account. We will keep the register for 2 years. All other information will be deleted.
7 Security measures
We use reasonable organizational, technical and administrative measures to protect your personal information within our organization and regularly check our system to detect any vulnerabilities. However, by virtue of the fact that the Internet is not a 100% secure environment, we can not guarantee or guarantee the security of the information you transmit to us. If you have an account on ATB Parts, you can log in to your account and see what information we have about you. You can cancel or modify these data at any time, remembering that they are useful for a correct work on our part.
If you do not have an account, you can send an email to email@example.com and request information about your personal data. After receiving your request, we will inform you what personal information we have about you, how we collect information, the purpose for which we process your personal data and with which entities we share your personal information.
10 Correction and deletion of your personal data
If any of your Personal Data or other personal information we hold about you as data controller is incorrect or misleading, you can personally rectify most of the information through your Account. We advise you to make the adjustments yourself. If not, you can ask us to help you rectify your information.
You may correct or delete at any time any personal content and information on the Website for which you are the data controller (see 3.2). In the event of changes to your personal information or if you no longer wish to appear on the Website, you may update or delete the information by accessing your Account.
If your Account is deleted, all data associated with your Account will be deleted, including the Personal Data and the history of the orders placed on our website.
